Holiday injury claims fall into two broad categories, and which one applies affects how the claim works. If you booked a package holiday, flights and accommodation together, through a UK tour operator, the operator is generally responsible for the standard of the accommodation and facilities, even though they didn't build or run them, under the Package Travel Regulations.
If you booked accommodation independently, the claim is generally against the hotel, venue or activity provider directly, which can mean dealing with a foreign law and insurance system, something we can still help manage.
What kinds of holiday injury claim do we handle?
Package holiday accidents
Including hotel and resort injuries covered by the Package Travel Regulations.
Independently booked accommodation injuries
Including hotels, villas and self-catering.
Swimming pool accidents
Including inadequate supervision or poor pool maintenance.
Slips, trips and falls at hotels and resorts
Including pool areas, stairs and poorly lit walkways.
Activity and excursion injuries
Including watersports and organised trips.
UK holiday park and caravan park accidents
Including on-site facilities, steps and entertainment venues.
What if I was partly at fault?
Partial responsibility reduces compensation proportionally rather than removing the claim. Accepting some risk in an activity you chose to take part in doesn't mean accepting negligence in how it was run.
What you could receive
Holiday injury claims cover general damages for the injury and its effect on your life, and special damages for financial losses, which can include the cost of medical treatment abroad, spoiled holiday costs in some cases, and lost earnings.
We'll talk you through what's realistic for your situation once we've reviewed the details. We won't overpromise, and we won't quote a figure before we've properly understood your case.
