Since 2021, most straightforward whiplash claims arising from road traffic accidents in England and Wales fall under the Whiplash Reform Programme. Lower value claims are handled through the Official Injury Claim portal directly, without a solicitor needing to be involved, and compensation for the injury itself is set by a fixed tariff rather than negotiated case by case.
That doesn't mean you're on your own, or that every whiplash claim fits neatly into this route. Claims involving a more serious injury, a longer recovery, additional injuries alongside the whiplash, or a claim value above the small claims threshold, work differently, and that's where getting advice actually changes the outcome.
What kinds of whiplash claim do we help with?
Straightforward road accident whiplash
Where you're not sure whether to use the Official Injury Claim portal yourself or get advice first.
Whiplash alongside other injuries
Where the whiplash is only part of a wider claim.
Whiplash with a longer or complicated recovery
Where the standard tariff process doesn't reflect what's actually happened.
Passenger whiplash claims
Including where multiple people in the same vehicle were affected.
Cases where liability is disputed
Which can complicate even a straightforward-looking whiplash claim.
What if I was partly at fault?
Partial fault doesn't prevent a whiplash claim. Where responsibility is shared, compensation may be reduced proportionally, and this is assessed the same way regardless of which process your claim goes through.
What you could receive
Whiplash compensation is now largely governed by a fixed tariff for the injury itself, set by government regulations rather than negotiated. Alongside that, you may be able to claim for financial losses separately, such as physiotherapy costs, travel to appointments, and lost earnings.
We'll talk you through what's realistic for your situation once we've reviewed the details. We won't overpromise, and we won't quote a figure before we've properly understood your case.
