Crush injuries are rarely accidents in the true sense. They're usually a warning that went unheeded

Being trapped or crushed by machinery, a vehicle, or a falling load causes some of the most serious workplace injuries we see, and they're almost always preventable with proper safeguarding.

Crush injuries happen where moving machinery lacks proper guarding, where vehicles like forklifts operate too close to people on foot, or where loads aren't secured or stacked safely. Employers are required to assess these risks and put controls in place, physical guards, exclusion zones, safe systems of work, not just hope nothing goes wrong.

Where that assessment wasn't done properly, or the controls weren't maintained or enforced, a claim usually follows.

What kinds of crush injury claim do we handle?

  • Machinery crush injuries

    Including inadequately guarded moving parts.

  • Vehicle and forklift crush injuries

    Including reversing incidents.

  • Falling or shifting loads

Including poorly stacked or secured stock.

  • Trapped-limb injuries

From doors, lifts and mechanical equipment.

  • Crush injuries in confined spaces

Where entry controls and rescue arrangements fell short.

What if I was partly at fault?

Partial responsibility reduces compensation proportionally rather than removing the claim. Given how serious these injuries typically are, it's rarely a reason to hold back from asking.

What you could receive

Crush injury claims cover general damages for the injury and its effect on your life, and special damages for financial losses, which are often substantial: lost earnings, extensive physiotherapy and rehabilitation, and where mobility is permanently affected, longer-term care and adaptations.

We'll talk you through what's realistic for your situation once we've reviewed the details. We won't overpromise, and we won't quote a figure before we've properly understood your case.

How does a claim actually work?

Four stages, and you always know which one you're in.

  1. 01

    Initial consultation

You tell us what happened. We give you a straight view on whether your claim has merit, free and with no obligation.

  2. 02

    Investigation

We gather evidence including machinery maintenance records, risk assessments, and any HSE involvement following the incident.

  3. 03

    Medical evidence

Where the injury is serious, we arrange an independent medical assessment and don't rush to settle before the long-term picture is clear.

  4. 04

    Negotiation and resolution

We'll explain exactly how our fee is calculated before you agree to anything.

Don't leave it late

How long do I have to claim?

Most personal injury claims must be brought within three years of the accident, or three years from the date you first connected your injury to it. For children, that three year clock starts on their eighteenth birthday.

If you're not sure whether you're still within the time limit, contact us. We'll tell you quickly.

The money side

What will it cost me?

Nothing upfront. Where a no win, no fee agreement applies, our fee comes from your compensation only if the claim succeeds, and it's set out in full, in writing, before you agree to anything.

  • We'll explain the funding options available for your claim, which may include a conditional fee (no win, no fee) arrangement, clearly and in full before you decide whether to proceed.
  • Where a conditional fee agreement applies and your claim succeeds, a success fee is deducted from your compensation. The law limits that fee in personal injury claims, and it is never taken from any damages awarded for future care or future loss of earnings. We explain exactly how it is worked out, in writing, before you agree to anything.
  • A cancellation fee may apply if you withdraw outside the 14 day cooling off period. Full details will be provided before you sign anything.
Common questions

Frequently asked questions

Was the HSE involved after my accident?

Serious workplace injuries are often reportable to the Health and Safety Executive, and any resulting investigation can provide useful evidence for a civil claim.

What if the machinery had a safety guard that failed?

That's still a live claim, a failed guard often points to inadequate maintenance or inspection, which is itself a failure of the employer's duty.

Can I claim if a colleague operating the machinery caused the injury?

Yes, an employer is generally responsible for the actions of employees carrying out their work, so the claim still proceeds against the employer.

How serious does the injury need to be to claim?

Any genuine injury caused by negligence can be claimed, though crush injuries specifically often involve more serious, longer-term consequences that need proper time to assess.
