You're a passenger. The claim doesn't turn on who you think was at fault

Sudden braking, a collision, a fall while boarding or alighting: public transport accidents happen in a range of ways, and as a passenger you're very rarely the one at fault.

Bus and coach operators owe passengers a duty of care, both in how vehicles are driven and in how safely passengers can board, travel and get off. Where sudden or dangerous driving, poor vehicle maintenance, or an unsafe boarding area caused your injury, a claim can be brought against the operator.

Where the accident actually involved a collision with another vehicle, the claim may instead, or additionally, be against that other driver's insurer.

What kinds of public transport accident claim do we handle?

  • Sudden braking or dangerous driving injuries

Including falls while standing on a moving bus.

  • Falls while boarding or alighting

Including from a vehicle not stopping properly at the kerb.

  • Injuries from collisions involving the bus or coach

Whether the driver or another road user was at fault.

  • Slips and falls inside the vehicle

    Including wet floors.

  • Injuries at bus stations and coach terminals

Including platform edges, barriers and unlit areas.

What if I was partly at fault?

Partial responsibility reduces compensation proportionally rather than removing the claim, for example if you weren't holding on when a reasonable passenger would have been.

What you could receive

Public transport accident claims cover general damages for the injury and its effect on your life, and special damages for financial losses, including lost earnings and treatment costs.

We'll talk you through what's realistic for your situation once we've reviewed the details. We won't overpromise, and we won't quote a figure before we've properly understood your case.

How does a claim actually work?

Four stages, and you always know which one you're in.

  1. 01

    Initial consultation

You tell us what happened. We give you a straight view on whether your claim has merit, free and with no obligation.

  2. 02

    Investigation

We gather evidence, including CCTV where available, incident reports, and witness details.

  3. 03

    Negotiation

We deal with the transport operator's insurer, or the at-fault driver's insurer where a collision was involved.

  4. 04

    Resolution

Once agreed, your compensation is paid. We'll explain exactly how our fee is calculated before you agree to anything.

Don't leave it late

How long do I have to claim?

Most personal injury claims must be brought within three years of the accident, or three years from the date you first connected your injury to it. For children, that three year clock starts on their eighteenth birthday.

If you're not sure whether you're still within the time limit, contact us. We'll tell you quickly.

The money side

What will it cost me?

Nothing upfront. Where a no win, no fee agreement applies, our fee comes from your compensation only if the claim succeeds, and it's set out in full, in writing, before you agree to anything.

  • We'll explain the funding options available for your claim, which may include a conditional fee (no win, no fee) arrangement, clearly and in full before you decide whether to proceed.
  • Our service is no win, no fee, so there is nothing to pay up front and nothing to pay if your claim does not succeed. We look after the costs of running your claim, and where it is appropriate we put insurance in place so that you are not left owing your opponent's costs if the claim is lost. If your claim succeeds, a fee is deducted from your compensation, as it is at most firms, and we explain it in full, in writing, before you agree to anything.
  • A cancellation fee may apply if you withdraw outside the 14 day cooling off period. Full details will be provided before you sign anything.
Common questions

Frequently asked questions

Do I need to have reported the accident to the driver at the time?

It helps, and many operators log incidents automatically, but a claim isn't ruled out if you didn't report it yourself.

Is CCTV footage usually available?

Often yes, most buses and coaches carry onboard CCTV, and we can request this as evidence, though it needs to be requested promptly before it's overwritten.

What if I don't know which company operates the service?

We can usually establish this from the route and time of travel.

Can I claim if I fell getting off, not during the journey itself?

Yes, if the vehicle didn't stop safely or the boarding area was hazardous, that's still a valid basis for a claim.
